Terms of Service

These Terms of Service ("Terms") govern your use of the Mailbox Copy email migration platform ("Service") operated by Trick Solutions ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Description of Service

Mailbox Copy provides an email migration platform that copies email messages between IMAP-compatible mail servers. The Service includes a web-based portal for managing migrations, server configurations, and credentials, as well as background worker processes that perform the actual email transfers.

2. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the Service
• One person or legal entity may maintain no more than one account
• You are responsible for all activity that occurs under your account

3. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Use the Service to migrate email from accounts you do not own or have authorization to access
• Attempt to access, copy, or migrate email belonging to other people without their explicit consent
• Use the Service to circumvent email provider security measures or terms of service
• Use the Service for any form of spam, phishing, or unsolicited bulk email
• Attempt to probe, scan, or test the vulnerability of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Resell access to the Service without a Business plan and explicit authorization
• Use the Service in violation of any applicable law or regulation

4. Mail Server Credentials

• You are solely responsible for the accuracy and authorization of the mail server credentials you provide
• You represent that you have the right to access and copy email from any source accounts you configure
• You represent that you have the right to write email to any destination accounts you configure
• We encrypt your credentials at rest and handle them according to our Privacy Policy
• We are not responsible for failed migrations due to incorrect credentials, server configuration, or access restrictions imposed by your mail providers

5. Email Content

• You retain all ownership rights to your email content
• We do not read, analyze, or store the content of your emails beyond what is necessary to perform the migration
• Email data passes through our servers during migration and is written directly to your destination server
• We are not responsible for data loss, corruption, or duplication that may occur during the migration process, though we take reasonable precautions to prevent these issues

6. Service Availability

• We strive to provide reliable service but do not guarantee uninterrupted or error-free operation
• We may perform maintenance that temporarily affects availability
• Migration speed and throughput depend on factors outside our control, including source and destination server performance, network conditions, and mail provider rate limits
• We reserve the right to limit concurrent migrations or throttle transfers to maintain service quality for all users

7. Subscription and Payment

• Paid plans are billed on a recurring basis (monthly or annually) through Stripe
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period
• We do not offer refunds for partial billing periods, except at our sole discretion
• We reserve the right to change pricing with 30 days advance notice
• Business plan per-mailbox charges are billed at the end of each billing period based on actual usage

8. API and White-Label Usage

• API keys are available to Business plan subscribers
• API keys are scoped to verified domains and must not be shared or exposed publicly
• We may rate-limit API usage to protect service quality
• You are responsible for securing your API keys. Compromised keys should be rotated immediately

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR DATA LOSS, CORRUPTION, OR UNAUTHORIZED ACCESS RESULTING FROM COMPROMISED CREDENTIALS, MAIL SERVER VULNERABILITIES, OR CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL

10. Indemnification

You agree to indemnify and hold harmless Trick Solutions and its employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

• You may delete your account at any time from the Settings page
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your data (including credentials and migration history) will be deleted in accordance with our Privacy Policy
• Provisions that by their nature should survive termination will survive (including liability limitations and indemnification)

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the State of Florida.
